Welcome to the ping.app, a platform for gamers to connect, build communities, and find new games to play. The Platform is a blockchain-enabled end-to-end digital ecosystem that deconstructs traditional revenue models by allowing the users of the platform to earn through their participation in the ecosystem. These Terms of Service (these “Terms”, “Agreement”) govern your access to and use of the Ping app app platform; including, our online and/or mobile services, and software provided on or in connection with those services (collectively, the “Site”).The Site also allows the selling, purchasing, lending, and renting of Non-Fungible Token (NFT) in-game characters via third-party websites.PRIVACY POLICY

If you wish to use the Ping app app platform, you will need to register for an account on the Site (“Account”). By creating an Account, you agree to (a) provide accurate, current, and complete Account information about yourself, (b) maintain and promptly update from time to time when necessary, your Account information, (c) maintain the security of your password and accept all risks of unauthorized access to your Account and the information you provide to us, and (d) immediately notify us if you discover or otherwise suspect any security breaches related to the Site, or your Account. Ping app app will block multiple accounts of the same user. Also, you agree that you will not:- 1.Create another account if we’ve disabled the one you had unless you have our written permission first;
- 2.Buy, sell, rent, or lease access to your Account or username unless you have our written permission first;
- 3.Share your Account password with anyone; or
- 4.Log in or try to log in to access the Site through unauthorized third-party applications or clients.
Ping app may require you to provide additional information and documents at the request of any competent authority or in case of application of any applicable law or regulation, including laws related to anti-money laundering (legalization of incomes obtained by criminal means), and/or the finance of terrorism. Ping app may also require you to provide additional information and documents in cases where it has reasons to believe that:- 1.Your Account is being used for money laundering, financing of terrorism or any other illegal activity;
- 2.You have concealed or reported false identification information and other details; or
- 3.Transactions effected via your Account were carried out in breach of these Terms.
In such cases, Ping app, in its sole discretion, may pause or cancel your activity on its platform, until such additional information and documents are reviewed by Ping app and accepted as satisfying the requirements of applicable laws and regulations. If you do not provide complete and accurate information and documents in response to such a request, Ping app may refuse to provide access to the platform.By creating an Account, you consent to receive electronic communications from Ping app (e.g., via email or by posting notices to the Site). These communications may include notices about your Account (e.g., password changes and other transactional information) and are part of your relationship with us. You agree that any notices, agreements, disclosures, or other communications that we send to you electronically will satisfy any legal communication requirements, including, but not limited to, such communications being in writing. You should maintain copies of electronic communications from us by printing a paper copy or saving an electronic copy. We may also send you promotional communications via email, including, but not limited to, newsletters, special offers, surveys, and other news and information we think will be of interest to you. You may not use any Meta tags or other “hidden text” utilizing “Ping app” or any other name, trademark, or product or the Site name of Ping app or our affiliates without our prior written permission. In addition, the look and feel of the Site and its’ Content, including, without limitation, all page headers, custom graphics, button icons, and scripts, constitute the Site mark, trademark, or trade dress of Ping app and may not be copied, imitated or used, in whole or in part, without our prior written permission. All other trademarks, registered trademarks, product names, and Ping app names or logos mentioned on the Site are the property of their respective owners and may not be copied, imitated, or used, in whole or in part, without the permission of the applicable trademark holder. Reference to any products, services, processes, or other information by name, trademark, manufacturer, and supplier or otherwise does not constitute or imply endorsement, sponsorship, or recommendation by Ping app.COPYRIGHT INFRINGEMENTS

You use all links in Third-Party Websites and Third-Party Applications at your own risk. When you leave our Site, our Terms and policies no longer govern you. You should review all applicable agreements and policies, including privacy and data gathering practices, of any Third-Party Websites or Third-Party Applications, and should make whatever investigation you feel necessary or appropriate before proceeding with any transaction with any third party.NFT MARKETPLACE
The Site facilitates interactions with the Protocols and Blockchain space to allow the users to buy, sell, lend and borrow NFTs (digital assets). Ping app does not provide the Protocol.You may participate in the Site by linking your digital wallet(s), which allows you to purchase, store, and engage in transactions on our platform. Before putting up your unique digital asset for sale or putting in an offer to purchase a unique digital asset from another user, we will ask you to install a supported digital wallet and connect and unlock your digital wallets. Once you submit an order to sell, purchase, lend or borrow a unique digital asset, your order is passed on to the applicable wallet, which completes the transaction on your behalf.GAMIC IS A PLATFORM. WE ARE NOT A BROKER, FINANCIAL INSTITUTION, OR CREDITOR. THE SERVICES ARE AN ADMINISTRATIVE PLATFORM ONLY. GAMIC FACILITATES TRANSACTIONS BETWEEN THE PURCHASER AND THE SELLER ON THE NFT MARKETPLACE BUT IS NOT A PARTY TO ANY AGREEMENT BETWEEN THE PURCHASER AND THE SELLER OF THE NFTs OR BETWEEN ANY USERS.YOU BEAR FULL RESPONSIBILITY FOR VERIFYING THE IDENTITY, LEGITIMACY, AND AUTHENTICITY OF ASSETS YOU PURCHASE THROUGH THE NFT MARKETPLACE. NOTWITHSTANDING INDICATORS AND MESSAGES THAT SUGGEST VERIFICATION, GAMIC MAKES NO CLAIMS ABOUT THE IDENTITY, LEGITIMACY, OR AUTHENTICITY OF ASSETS ON THE NFT MARKETPLACE.Transactions are conducted solely on the Blockchain. While Ping app offers a marketplace for NFTs, it does not buy, sell or take custody or possession of any NFTs, nor does it act as an agent or custodian for any user of the Site. Instead, each NFT that is listed for sale will be deposited into a blockchain-based smart contract deployed by the Site. Each such NFT is released automatically upon consummation of its sale through the relevant Blockchain network. If you elect to buy, sell, lend or borrow any NFTs, any transactions that you engage in will be conducted solely through the relevant Blockchain network governing such NFTs. You will be required to make or receive payments exclusively through the cryptocurrency wallet you have connected to your account. We will have no insight into or control over these payments or transactions, nor do we have the ability to reverse any transactions. Accordingly, we will have no liability to you or to any third party for any claims or damages that may arise as a result of any transactions that you engage in via the Site. There may be royalties associated with the secondary sale or the borrowing of any NFT. You acknowledge and agree that the payment of any such royalty shall, in certain circumstances, be programmed to be self-executing via a blockchain network’s nonfungible token standard. Ping app does not have any control or ability to direct such funds or the obligation to collect such fees.GG REWARDS
Ping app offers its users rewards “GG Rewards” for using its platform. The reward can be earned through the following means:- 1.Register on the platform.
- 2.Daily conversations on the platform
- 3.Referrals.
- 4.Space activities reward to community owners
The value of the GG reward is virtual and should not be taken to mean a one-to-one conversion to any real currency until such a time, to be determined by Ping app, when the GG rewards would be convertible to other tokens, or withdrawable by the user.Ping app reserves the right to determine the rate of conversion to be used when converting to other tokens.Ping app also reserves the right to determine when the GG rewards would become withdrawable by the user.USER CONDUCT
You agree that you will not violate any law, contract, intellectual property, or another third-party right and that you are solely responsible for your conduct while accessing or using the Site. You agree that you will abide by these Terms and will not:Provide false or misleading information to Ping app;
Use or attempt to use another user’s Account without authorization from such user and Ping app;
Pose as another person or create a misleading username;
Use the Site in any manner that could interfere with, disrupt, negatively affect or inhibit other users from fully enjoying the Site, or that could damage, disable, overburden or impair the functioning of the Site in any manner;
Develop, utilize, or disseminate any software, or interact with any API in any manner, that could damage, harm, or impair the Site;
Reverse engineer any aspect of the Site, or do anything that might discover source code or bypass or circumvent measures employed to prevent or limit access to any service, area, or code of the Site;
Attempt to circumvent any content-filtering techniques we employ, or attempt to access any feature or area of the Site that you are not authorized to access;
Use any robot, spider, crawler, scraper, script, browser extension, offline reader, or other automated means or interface not authorized by us to access the Site, extract data or otherwise interfere with or modify the rendering of Site pages or functionality;
Use data collected from our Site to contact individuals, companies, or other persons or entities;
Use data collected from our Site for any direct marketing activity (including without limitation, email marketing, SMS marketing, telemarketing, and direct marketing);
Bypass or ignore instructions that control all automated access to the Site;

You agree to promptly notify Ping app of any third-party Claims and cooperate with the Ping app Parties in defending such Claims. You further agree that the Ping app Parties shall have control of the defense or settlement of any third-party Claims.DISCLAIMERS

It requires you to arbitrate disputes with Ping app and limits how you can seek relief from us.You agree that any dispute or claim relating in any way to your access or use of the Site, to any products sold or distributed through the Site, or to any aspect of your relationship with Ping app, will be resolved by binding arbitration, rather than in court (Arbitration Agreement), except that (1) you may assert claims in small claims court if your claims qualify; and (2) you or Ping app may seek equitable relief in court for infringement or other misuses of intellectual property rights (such as trademarks, trade dress, domain names, trade secrets, copyrights, and patents).The arbitrator shall have exclusive authority to (a) determine the scope and enforceability of this Arbitration Agreement and (b) resolve any dispute related to the interpretation, applicability, enforceability, or formation of this Arbitration Agreement including, but not limited to any claim that all or any part of this Arbitration Agreement is void or voidable. The arbitration will decide the rights and liabilities, if any, of you and Ping app. The arbitration proceeding will not be consolidated with any other matters or joined with any other cases or parties. The arbitrator shall have the authority to grant motions dispositive of all or part of any claim. The arbitrator shall have the authority to award monetary damages and to grant any non-monetary remedy or relief available to an individual under applicable law, the arbitral forum’s rules, and the Terms (including the Arbitration Agreement).The arbitrator shall issue a written award and statement of decision describing the essential findings and conclusions on which the award is based, including the calculation of any damages awarded. The arbitrator has the same authority to award relief on an individual basis that a judge in a court of law would have. The award of the arbitrator is final and binding upon you and us.YOU AND GAMIC HEREBY WAIVE ANY CONSTITUTIONAL AND STATUTORY RIGHTS TO SUE IN COURT AND HAVE A TRIAL IN FRONT OF A JUDGE OF ANY COURT OF COMPETENT JURISDICTION. You and Ping app are instead electing that all claims and disputes shall be resolved by arbitration under this Arbitration Agreement, except as specified above. An arbitrator can award on an individual basis the same damages and relief as a court and must follow these Terms as a court would. However, there is no judge in arbitration, and court review of an arbitration award is subject to applicable laws and regulations.ALL CLAIMS AND DISPUTES WITHIN THE SCOPE OF THIS ARBITRATION AGREEMENT MUST BE ARBITRATED ON AN INDIVIDUAL BASIS AND NOT ON A COLLECTIVE CLASS BASIS, ONLY INDIVIDUAL RELIEF IS AVAILABLE, AND CLAIMS OF MORE THAN ONE USER CAN NOT BE ARBITRATED OR CONSOLIDATED WITH THOSE OF ANY OTHER USER.If any part or parts of this Arbitration Agreement are found under the applicable laws and regulations to be invalid or unenforceable, then such specific part or parts shall be of no force and effect and shall be severed and the remainder of the Arbitration Agreement shall continue in full force and effect.This Arbitration Agreement will survive the termination of your relationship with Ping app.CORRECTIONS
There may be information on the site that contains typographical errors, inaccuracies, or omissions, including descriptions, availability, pricing, and various other information. We reserve the right to correct any errors, inaccuracies, or omissions and to change or update the information on the Site at any time, without prior notice to you. SEVERABILITY
If any term, clause, or provision of these Terms of Service is held invalid or unenforceable, then that term, clause, or provision will be severable from these Terms and will not affect the validity or enforceability of any remaining part of that term, clause or provision, or any other term, clause or provision of these Terms.MISCELLANEOUS
These Terms of Service along with the Privacy Policy form the entire agreement between you and Ping app relating to your access to and use of the Site and its’ Content. These Terms, and any rights and licenses granted hereunder, may not be transferred or assigned by you without the prior written consent of Ping app under any prior, concurrent, or subsequent circumstance, and Ping app’s failure to assert any right or provision under these Terms shall not constitute a waiver of such right or provision.
